1. Parties to This Agreement

1.1  These Terms & Conditions apply to all bookings made with Willy Banjo Ltd (trading as BBS Adventure), operator of www.bbsadventure.com (“BBS Adventure”, “we”, “us”, “our”). 1.2  Willy Banjo Ltd is a company registered in England and Wales under company number 04972535, whose registered address is 13a Lowthian Street, Preston, Lancashire, PR1 2EP. 1.3  All tours, motorcycle hire, and on-the-ground services in Bulgaria are delivered on our behalf by Enduro Ride Ltd Bulgaria (EIK: 205653785), a company incorporated under Bulgarian law (“the Ground Operator”). By booking with BBS Adventure, you acknowledge that the Ground Operator is responsible for the delivery of services in Bulgaria. 1.4  “You” / “Customer” means the adult individual (aged 18 or over) who makes a booking and all participants included in that booking.

2. Booking & Deposit

2.1  A booking is confirmed only when we have received your completed booking enquiry and we have issued written confirmation by email. 2.2  A non-refundable booking deposit of 10% per rider is required to secure your place. This must be paid by bank transfer as directed in your booking confirmation. 2.3  The remaining balance is due and must be paid in full upon arrival in Bulgaria before your tour begins. 2.4  Any quotation is valid for 5 days from the date of issue unless expressly withdrawn earlier. 2.5  Prices are as set out on www.bbsadventure.com and in your written booking confirmation, and include all items listed as included in your specific tour package. 2.6  Where VAT is chargeable it will be applied at the applicable rate and shown separately on your invoice. Tour packages delivered in Bulgaria by the Ground Operator may be subject to Bulgarian VAT where applicable under local law; any such charges will be confirmed in your booking confirmation.

3. What Is Included & Excluded

Included in all BBS Adventure Tours

• Airport transfer (arrival and departure)
• Hotel accommodation (twin / double room)
• Breakfast, lunch, and dinner as stated in your tour itinerary
• Motorcycle or buggy hire and fuel for riding days
• Professional guide(s) and tour manager
• Mechanic and safety vehicle support
• Bike damage waiver (see Section 6)

Not Included

• International flights
• Personal accident / travel insurance (mandatory — see Section 5)
• Alcohol and minibar
• Riding gear, if not hired from us (available at €55 per person per day)
• Any costs arising from your own negligence, wilful misconduct, or behaviour in breach of these Terms

4. Cancellation & Refunds

4.1  All BBS Adventure tours are leisure activities booked for a specific date and period of performance. The statutory 14-day cooling-off right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply. 4.2  The booking deposit is non-refundable in all circumstances. 4.3  We do not offer cash refunds on tour balances once paid, regardless of when cancellation notice is given. 4.4  If you need to cancel, you may instead:

• Transfer your booking to a new available tour date (subject to availability, agreed in writing with BBS Adventure); or
• Transfer your booking to another eligible rider, who takes on all rights and obligations under your original booking.

4.5  Any cancellation must be notified to us in writing to hello@bbsadventure.com as soon as possible. 4.6  BBS Adventure reserves the right to cancel or reschedule a tour in exceptional circumstances beyond our reasonable control (see Section 11). In this event we will offer an alternative date or a full refund of monies paid to us.

5. Insurance — Your Responsibility

5.1  Your insurance must cover:

• Off-road motorcycle riding and/or buggy driving
• Emergency medical treatment in Bulgaria
• Helicopter evacuation and rescue
• Repatriation to your country of residence
• Third-party liability for injury to others or damage to property

5.2  Standard travel insurance is not sufficient. You must ensure your policy specifically covers the activities you will be undertaking. 5.3  BBS Adventure and the Ground Operator accept no liability for any costs arising from your failure to hold appropriate insurance.

6. Bike Damage Waiver & Security Deposit

6.1  Your tour price includes a bike damage waiver. Subject to clause 6.3, this covers accidental damage to the external plastics and peripheral parts of your motorcycle or buggy during normal riding. 6.2  If you choose not to accept the damage waiver, a fully refundable security deposit of €200 per bike/buggy will be collected at the start of your tour. At the end of the tour, the cost of any damage will be assessed and deducted from the deposit; the remainder will be returned to you. 6.3  The damage waiver and security deposit do not cover:

• Engine damage caused by abusive, reckless, or negligent riding (e.g. hydraulic lock, ignoring warning lights, or riding in a manner that constitutes misuse)
• Damage caused while under the influence of alcohol or drugs
• Theft of the motorcycle or buggy
• Damage caused by gross negligence or wilful misconduct

6.4  In the event of damage not covered by the waiver, you will be liable for the full cost of repair or replacement as assessed by the Ground Operator’s mechanic.

7. Health, Fitness & Rider Responsibility

7.1  You confirm that you are in good physical health and have no medical condition that would make participation dangerous to yourself or others. If in doubt, seek medical advice before booking. 7.2  You confirm that you have sufficient riding experience for the tour level you have booked. BBS Adventure and the Ground Operator reserve the right to remove any participant from a tour at any time if, in the guide’s reasonable opinion, their conduct or ability poses a risk to themselves or others. No refund will be given in such circumstances. 7.3  You must wear appropriate safety equipment at all times whilst riding — including a helmet, body armour, knee guards, and gloves. Riding gear is available for hire if you do not bring your own. 7.4  You must not ride under the influence of alcohol or drugs. Any participant found to be impaired will be removed from the tour immediately with no refund. 7.5  You are responsible for your own conduct and safety, and for the safety of those around you, at all times.

8. Liability & Risk Acknowledgement

8.1  BBS Adventure and the Ground Operator will make every reasonable effort to ensure your safety. However, we are not liable for any loss, injury, death, or damage arising from:

• The inherent risks of off-road motorcycling, buggy driving, or other tour activities
• Your own actions, negligence, or failure to follow guide instructions
• Events beyond our reasonable control (see Section 11)
• Third-party actions
• Your failure to hold appropriate insurance as required by Section 5

8.2  Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot lawfully be excluded. 8.3  Subject to clause 8.2, our total liability for any claim shall not exceed the total price paid by you for your tour. 8.4  We are not liable for any loss of profit, loss of enjoyment, indirect, or consequential losses. 9. Photography, Filming & Social Media 9.1  BBS Adventure and the Ground Operator photograph and film tours for use on our website, social media channels, and promotional materials. This is part of the BBS Adventure experience and helps us share the best of what we do. 9.2  If you do not wish to appear in photographs or videos, please inform your guide at the start of the tour. We will make reasonable efforts to exclude you from content intended for publication. 9.3  If you do not raise an objection with your guide, we will consider this as your permission for us to use images or footage in which you appear for the purposes described in clause 9.1. 9.4  We will not sell your image to third parties or use it in any context unrelated to BBS Adventure’s own promotional activity.

10. Services Delivered by the Ground Operator

10.1  All on-the-ground services in Bulgaria — including motorcycle and buggy hire, guiding, accommodation arrangements, and transfer logistics — are delivered by Enduro Ride Ltd Bulgaria (EIK: 205653785) acting as sub-contractor to BBS Adventure. 10.2  BBS Adventure accepts responsibility for the selection and instruction of the Ground Operator. The Ground Operator will be liable for the acts and omissions of its employees and guides in the delivery of services. 10.3  Any complaints or issues arising during the tour should be raised immediately with your guide or tour manager so they can be resolved on the spot.

11. Circumstances Beyond Our Control

11.1  BBS Adventure and the Ground Operator will not be liable for any failure or delay caused by circumstances beyond our reasonable control, including but not limited to: extreme weather, natural disaster, fire, flood, epidemic, war, civil unrest, government action, or trail closures. 11.2  Where a tour cannot proceed due to such circumstances, we will notify you as soon as reasonably practicable and offer either an alternative date or a full refund of monies paid to BBS Adventure.

12. Complaints

12.1  If you have a problem during your tour, please raise it immediately with your guide or tour manager. Most issues can be resolved on the spot — ideally while we’re still on the ground in Bulgaria. 12.2  If your complaint is not resolved during the tour, please contact us in writing within 28 days of returning home: hello@bbsadventure.com. 12.3  We will acknowledge your complaint within 5 working days and aim to provide a full response within 14 days.

13. Data Protection

13.1  We process your personal data in accordance with UK GDPR and the Data Protection Act 2018. For full details please see our Privacy Policy at www.bbsadventure.com/privacy-policy. 13.2  We will use your personal data only for the purpose of managing your booking and providing the services you have requested.

14. General

14.1  These Terms & Conditions are governed by the law of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. 14.2  If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force. 14.3  No waiver by us of any breach shall constitute a waiver of any subsequent breach. 14.4  These Terms, together with your booking confirmation and our Privacy Policy, constitute the entire agreement between you and BBS Adventure relating to your tour. 14.5  We reserve the right to update these Terms at any time. The version in force at the time of your booking confirmation shall apply to your booking. 14.6  You may not transfer your booking rights without our written consent, except as set out in Section 4.
